Regulations
on the procedure for expulsion, interruption of training, renewal, and transfer of individuals enrolled in the IAPM, as well as granting them academic leave
- General provisions
- This Regulation defines the mechanism of expulsion, interruption of studies, renewal, and transfer of individuals receiving higher education at the Private Higher Education Institution “International Academy of Ecology and Medicine” (hereinafter referred to as the Academy or the university), as well as granting them an academic leave.
- This Regulation is mandatory for all employees of the Academy following the requirements for the procedure for expulsion, interruption of studies, renewal, and transfer of individuals studying at the Academy, as well as granting them a study leave within the framework of the latter’s official duties.
- In these Regulations, the terms are used in the following meanings:
expulsion – termination of the status of a higher education student, the rights and obligations of an individual receiving higher education;
transfer – changes in the rights and obligations of an individual receiving higher education due to a change in a higher education institution and/or major (specialization, educational (scientific) program) and/or form of study and/or sources of funding without termination of the status of an individual receiving higher education;
interruption of study – partial suspension of the rights and obligations of a higher education student due to circumstances that make it impossible to fulfill an individual curriculum or individual research plan;
reinstatement – restoration of the status of a higher education student, rights and obligations of an individual who receives higher education.
- Renewal and transfer of higher education applicants from foreign higher education institutions to educational programs based on complete general secondary education is possible only if the requirements of the Law of Ukraine “On Higher Education” are met in terms of successful completion of external independent evaluation of knowledge and skills of applicants according to the list of external independent evaluation certificates established for this educational program in the year of completion of complete general secondary education or in one of the following years no later than the application for renewal or transfer.
- Renewal and transfer of higher education applicants to master’s degree programs that provide for the passing of entrance examinations in the form of a single professional entrance examination and/or a single professional entrance examination are possible only if they are successfully passed in the year of admission or one of the following years no later than the application for renewal or transfer.
- Expulsion of individuals enrolled in higher education institutions
- The grounds for expulsion of students are (Article 46 of the Law of Ukraine “On Higher Education”):
- completion of the relevant educational (scientific) program;
- their desire;
- transfer to another higher education institution;
- failure to fulfill the individual curriculum (or individual research plan);
- violation of the terms of the agreement (contract) concluded between the higher education institution and the student or the individual (legal entity) paying for such training;
- other cases provided for by law.
- In pursuance of Section II, Part I, Clause 4 of these Regulations, an exhaustive list of circumstances that are considered to be a failure to complete an individual curriculum is determined by the regulations on the organization of the educational process at the Academy, approved following part two of Article 47 of the Law of Ukraine “On Higher Education” (hereinafter – the Regulations), in compliance with the totality of the following requirements:
- failure to fulfill the individual curriculum is established solely based on the results of semester control or certification of higher education
- skipping classes, if it does not lead to a student receiving a failing grade based on the results of semester control, cannot be considered a failure to fulfill the individual curriculum;
- expulsion in connection with receiving an unsatisfactory grade during semester control measures is possible only if the higher education student:
regardless of the number of unsatisfactory grades received, the applicant was allowed to improve the assessment results, and the applicant did not take advantage of this opportunity within the established time limit or received an unsatisfactory grade based on the results of reassessment;
the applicant was allowed to appeal the decisions, actions, or inaction of pedagogical, scientific, and pedagogical staff, officials (representatives of the administration) of the higher education institution regarding the organization and conduct of semester control activities following the procedure established by the higher education institution, and the applicant did not use this opportunity within the established time limit or their appeal was rejected;
the opportunity was provided to transfer to study at the expense of individuals and/or legal entities (for individuals obtaining higher education by state (regional) order) or interrupt their studies, and the applicant did not use this opportunity within the prescribed time frame;
- a student may not be expelled if the failure to fulfill the individual curriculum was due to the fault (as a result of intentional actions or gross negligence) of the Academy if this is established by the university commission with the participation of representatives of student self-government bodies.
- Violation by a postgraduate student of the requirements of the Statute or the Internal Regulations of the Academy, requirements for labor protection, safety, industrial sanitation, fire safety, provided for by the relevant rules and instructions approved by the general meeting of the Academy and agreed by the Academic Council may be grounds for expulsion, provided that such grounds are specified in the agreement (contract) after exhaustion of other means of influence (or impossibility of their application) only following the procedure established by the Internal Regulations of the Academy.
- Violation of the deadlines for the implementation of the individual research plan without valid reasons provided for by the requirements of the Academy may be grounds for the Academic Council of the university to decide to expel the postgraduate student.
- The Rector of the Academy expels from the higher education students after agreeing with:
- student self-government bodies of the Academy – for students and trainees;
- the scientific society of students, trainees, and postgraduate students.
III. Reinstatement to higher education students
- Individuals who were expelled before completing their studies under an educational (scientific) program of higher education of the appropriate level or who were granted an academic leave may be reinstated as higher education students.
- Reinstatement is carried out regardless of the reason for expulsion, duration of the break in education, form of study, specialty and field of study, type of program, sources of funding, form of ownership of the higher education institution, taking into account the applicant’s ability to complete the curriculum.
Reinstatement to the first year of higher education programs based on complete general secondary education is prohibited. The Rector of the Academy shall have the right to reinstate individuals expelled from the first year of study based on complete general secondary education to the second year of study, provided that they eliminate academic debt before the start of classes.
- Reinstatement is carried out in educational (scientific) programs of the same degree (level) from which the higher education student was expelled, for the same or a junior year.
- Reinstatement of higher education students is carried out within the licensed volume of the Academy for the relevant level, course, and specialty. Exceeding the licensed volume is possible only by following applicable law.
- The renewal application must be considered by the Academy within two weeks. An academic transcript is attached to the application for renewal. Based on the results of the application review, the applicant must be informed of the conditions for reinstatement to higher education or the reason for refusal.
- A condition for reinstatement may be the prior completion or inclusion in the individual curriculum of certain compulsory disciplines and/or a certain amount of elective disciplines of the educational program. The procedure for re-enrollment of learning outcomes (credits, disciplines) and reinstatement to higher education is determined in the Regulations.
- The Rector of the Academy reinstates higher education students in agreement with the student self-government bodies (Section II, paragraph 5 of the Regulations).
- Transfer of higher education students
- Individuals enrolled in higher education institutions may be transferred from:
- academy to another higher education and training institution;
- one specialty (specialization, educational (scientific) program) to another;
- from one source of funding to another.
- Transfer of full-time students is usually carried out during vacations unless otherwise provided by the current legislation of Ukraine.
- Transfer is carried out to educational (scientific) programs of the same degree (level), as well as to the same or a junior year. In exceptional cases, transfer from one specialty to another is possible only by decision and order of the Rector of the Academy.
- The transfer of higher education students is carried out within the licensed volume of the higher education institution at the appropriate level, course, and specialty. Transfer to the first year is prohibited.
- Transfer of higher education students from the Academy to another higher education institution and vice versa is carried out with the consent of the heads of both higher education institutions. A higher education applicant who wishes to transfer to another higher education institution shall apply for transfer to the head of the higher education institution in which they are studying and, having received their written consent, shall submit this application to the head of the higher education institution to which they wish to transfer and attach a copy of the academic record or other document (statement, academic certificate, certificate of progress) containing information on the results of study.
Higher education students who are studying at the expense of individuals or legal entities may be transferred with the consent of the individual who finances the study.
The transfer application must be considered within two weeks and the applicant must be informed of the terms of the transfer or the reason for refusal.
In case of positive consideration of the application and fulfillment of the transfer conditions, the head of the higher education institution issues an order according to which the applicant is admitted to classes and sends a request to the Academy to receive their file.
The transfer of higher education students within one higher education institution is carried out by the rector of the Academy based on the conclusion of the dean’s office of the School of Medicine, which provides the legal basis for such a decision.
- A condition for transfer may be the prior completion or inclusion in the individual curriculum of certain compulsory disciplines and/or a certain amount of elective disciplines of the educational program.
The procedure for re-accrual of learning outcomes (credits, disciplines, etc.) is determined in the Regulations of the Academy.
- The Rector of the Academy, having received a request from another university, issues an order to expel a higher education student in connection with his transfer to another higher education institution, to which he sends a personal file within a week.
The head of the higher education institution to which the higher education student is transferred, upon receipt of the personal file, issues an order for their enrollment and makes appropriate changes to the EDEBO. Similar actions are taken by the responsible employees of the Academy in case of receipt of the personal file of the transferred higher education student.
- In case of expiration of the certificate of accreditation of the educational program (specialty, field of study) and failure of the Academy to receive a new certificate of accreditation, higher education students have the right to transfer to another higher education institution.
- Interruption of studies of individuals enrolled in higher education institutions and granting of academic leave
- Individuals who have interrupted their studies at the Academy shall be granted an academic leave. Individuals who are granted academic leave are not expelled from the number of higher education students and retain certain rights of a higher education student following the law and the Regulations on the organization of the educational process at the Academy.
- Individuals studying at the Academy may be granted the following types of academic leave:
- academic leave for health reasons – a break in studies, the right to which a higher education student receives in case of reduced ability to work due to impaired body functions caused by acute diseases requiring long-term rehabilitation treatment; exacerbations of chronic diseases or frequent illnesses (more than one month per semester); anatomical defects that do not allow for rehabilitation treatment during studies;
- academic leave in connection with participation in academic mobility programs – a break in study, which is granted to a higher education student if study or internship in educational and scientific institutions (including foreign countries) makes it impossible to fulfill an individual curriculum (individual research plan);
- academic leave in connection with military service – a break in studies, the right to which a higher education student receives in case of mobilization, call-up for regular military service, enrollment in military service under a contract following the law;
- academic leave for the period remaining until the end of the standard period of postgraduate (adjunct) or doctoral studies. – a break in studies that may be granted to a postgraduate student (adjunct) or doctoral student who defended their thesis before the end of the period of postgraduate (adjunct) or doctoral studies following the Procedure for the training of higher education students for the degree of Doctor of Philosophy and Doctor of Science in higher education institutions (research institutions), approved by the Resolution of the Cabinet of Ministers of Ukraine No. 261 of March 23, 2016;
- academic leave for family and other personal reasons
- a break in studies, the procedure for granting which is determined by the higher education institution and which is granted to a student based on their motivated application (with supporting documents, if necessary).
- academic leaves for pregnancy and childbirth leave to care for a child until the child reaches the age of 3, and in case the child is ill and needs home care – until the child reaches the age of 6, are granted following the Labor Code of Ukraine.
- academic leave for other reasons that do not contradict the current legislation.
- The granting of an academic leave shall be formalized by the relevant order of the Rector of the Academy, indicating the type and grounds for granting the academic leave and its duration.
- The maximum duration of an academic leave for health reasons, in connection with participation in academic mobility programs, family and other personal circumstances is set at one year and may be extended for another year.
- Academic leave for health reasons is granted to higher education students based on the conclusion of the Medical Advisory Commission (hereinafter – MAC) of the student clinic, and where it is absent, the chief physician of the medical and preventive institution (hereinafter – MPI) that provides medical care to students of the Academy (by agreement). Academic leave for foreign higher education students is granted based on a legalized medical certificate obtained in a foreign country, which is submitted to the higher education institution together with a notarized translation into Ukrainian.
If a sick higher education student is unable to go there due to their condition and distance from the health care facility that provides medical care to students, they may seek medical care at a territorial health care facility and receive an extract from the medical record after treatment.
- The conclusions of doctors of departmental and territorial medical institutions on the need to grant full-time students an academic leave for health reasons (as well as exemption from physical labor, postponement of the terms of internship) require confirmation by the decision of the Clinical Commission or the chief physician (head) of the medical institution serving students by agreement.
In exceptional cases, when doctors providing medical care to students are unable to conduct a medical examination of a sick student due to their condition and remoteness from the medical institution serving students, the Academy management (with the consent of the medical institution serving students) decides to grant an academic leave based on the conclusion of the Medical Examination Committee of the medical institution where the student is treated.
- When deciding on the need to grant an academic leave of absence for health reasons, the following shall be taken into account:
The duration of temporary disability (more than one month per semester); the specifics of the educational process; the profile of the higher education institution; the degree of adaptation of the higher education student; the possibility of deterioration of health (transition of an acute disease to a chronic disease, disability) if the individual continues to study.
Based on the review of the extract from the medical history and medical examination data, the HQC (in the absence of the HQC, the chief physician), with the participation of a representative of the Academy (if necessary), concludes that the student should be granted an academic leave or transferred for health reasons to study in another specialty or to another higher education institution. The conclusion of the SQC indicates the recommended duration of the academic leave for health reasons.
- To decide on the issue of reinstatement of higher education students whose academic leave for health reasons expires, it is necessary to submit to the health care institution a health certificate from the health care institution that observed the patient during the academic leave two weeks before the start of the semester.
- The reinstatement of higher education students whose academic leave has expired is carried out by order of the Rector of the Academy based on the student’s application, which is submitted no later than two weeks before the end of the academic leave period. In case of academic leave for health reasons, the application must be accompanied by a JIKK conclusion.
Higher education applicants who fail to submit documents for admission to study or documents for extending the period of academic leave within the established deadline are expelled from the higher education institution.
- All controversial issues regarding the granting of academic leave shall be considered by the management of the higher education institution with the participation of student self-government bodies or the scientific society of students, trainees, and postgraduates.
- Re-education in higher education institutions
- Re-education is the repeated passage by a higher education student of disciplines in which they did not receive the minimum number of points established by the higher education institution.
Applicants for higher education in the first year of higher education institutions based on complete general secondary education do not have the right to repeat their studies.
- The grounds for granting a higher education student the right to repeat studies may be a failure to fulfill the individual curriculum of the current semester before the start of semester control measures, including for valid reasons confirmed by relevant documents.
Certificates of illness of a higher education student during the semester are certified by the health care facility that serves him/her and submitted to the higher education institution within a week after the end of treatment.
- For doctors to make a decision, a request from the Academy, a detailed extract from the medical history from the medical institution under whose supervision the applicant is, and a full medical examination are submitted to the medical institution. During the expert decision on the need to provide re-education due to prolonged or frequent illnesses, the following are taken into account: the duration of temporary disability (more than one month per semester); the specifics of the educational process; the specifics of the higher education institution, specialty; the degree of adaptation of the applicant; the possibility of deterioration of health (transition of an acute disease to a chronic disease, disability) if the applicant continues to study.
- The issue of granting the higher education student the right to repeat study is decided by the rector of the Academy on the proposal of the dean of the School of Medicine before the beginning of the relevant semester and is formalized by the relevant order.
- Re-education is carried out within the terms determined by the higher education institution.
VII. Preparation of documents
- An individual expelled from the Academy shall be issued an academic certificate, the form of which is approved by the Order of the Ministry of Education and Science of Ukraine dated May 12, 2015 No. 525 and registered with the Ministry of Justice of Ukraine on May 18, 2015 under No. 551/26996.
In case of interruption of studies following the contractual terms with Appendix No. 1, a higher education student is entitled to receive an academic certificate.
In the case of transferring a student, a copy of the academic certificate signed by the rector of the university and sealed with his seal (if any), a record book certified by the dean of the faculty, a student card, and a student card signed by the dean of the faculty with a seal (if any) indicating the implementation of the individual curriculum remain in the Academy’s file.
- Information about the disciplines studied, defended term papers, and reports on practice, tests, and exams passed are entered into the academic transcript separately for each semester.
The academic transcript does not include subjects in which the student received unsatisfactory grades. Applicants who have withdrawn from the first year of a higher education institution and have not taken exams and tests are issued an academic transcript stating that the applicant has not taken tests and exams.
- A student who has been reinstated in or transferred to a higher education institution shall be issued a record book or other document containing information about the learning outcomes obtained, with the re-enrolled disciplines with the appropriate grades.
The procedure for re-enrollment in disciplines is established by the Academy following applicable law.
The personal file of a student transferred from another higher education institution includes an extract from the order of enrollment, an application, and an academic transcript.
The personal file of a higher education student must be drawn up following the current legislation and the list of required documents.
